Removal of Cap for Disposing of Municipal Property

Therefore Be It Resolved that Municipalities Newfoundland and Labrador lobby the Department of Municipal Affairs to amend section 201.1 of the Municipalities Act, 1999, so that:a) A municipality will be required to sell all real property at fair market value and that a municipality will not have to go to auction or public notice if fair market value can be achieved through a private sale; and b) A municipality may dispose of real property for less than fair market value only when it is sold to nonprofit organization that the council considers to be carrying on an activity that is beneficial to the municipality or when the land is of no value except to an adjacent land owner; and c) The cap that triggers public auction or tender for personal property be increased to $5000; and d) The disposal of personal property valued at less than $5000 will not be governed by s.201.1 e) a municipality may sell real property at less than fair market value, in special circumstances, with the prior approval of the Minister of Municipal Affairs.
